Cheque fraud (kind of)

    legally you owe them the money, however...

    like pike said, chances of them actually being able to get your details are zero. without your details they can't issue you with a summons.

    if they do get your details somehow, you'll get a demand for it first. even then i would be amazed if they were to take it any further, so i would even ignore that aswell.

    you's were both at fault...you should not have wrote the cheque for £150 knowing you cheque garuntee limit was £100 but they should've picked up on this...

    it probs went unpaid cos they banked it on the mon when you didn't have enough funds in...

    i would also try ignoring them but if they won't leave you alone just pay them...

    best thing to do which i always do when witheld callers call me is when they say

    "can i speak to Mr Asbrige please"

    i simply reply

    "im sorry he isnt available at the moment, can i take a message"

    "they'll either possible persue it further and ask when your home

    and u then ask "can i ask who's calling please"

    they will either tell u (or if its a debt collecting agency they probs will just try and call back another time

    they will probs leave a name and numebr so u can contact em back

    noone can ever contest it isnt you, and it means u never have to speak to them when they want you too

    u can then choose to call em back :)

    also gives ya a wierd sense of entertainment

    they cant take money out of your account with your acc number and sort code, they need ur card details, and even then they wouldnt be allowed without ur permission

    ur pretty much safe, i dont think they will come chasing u up about £150, they wont even take u to court, it wouldnt be worth the court fees tbh

    debt collection always ask "HI, AM I SPEAKING WITH <name>" straight away.

    they can try to re-cash the cheque until they get their money tho :)

    its not cos the business can try to re bank it to see if they can get the cash...if the customer doesn't have cash in the bank they can get charged off the bank

    My Mam and dads shop has had cheques bigger then that bounced on them, the bank don’t want to know, the most they will do is send you a letter. it's not worth them taking it up with a debit collection company because they charge allot more then you owe.
    The only thing they can do is represent the cheque to the bank and if you still don’t have the money you'll get charged by your bank, but they can only do this 3 times so it depend how much your bank charges for bouncing cheques if its worth paying or not. I'd just tell them to piss if they ring you again. Your bank will not give them your address.

    if you have no money at the time it will be stamped represent, but you can only represent it 3 times

    From doing a bit of reading on the internet yesterday i thought i when i cheque is presented and there's not enough funds to cover it the bank will mark it 'refer to drawer', and once it's marked like this it's useless to the restaurant?

    Does you mean they can just try sending it back to the bank then?

    Just had a missed call from the restaurant. English guy on the voicemail asking politely if i can give him a call regarding a meal i had in October. They're not even smart enough to withhold their number, so it flashes up saying 'Ivy calling'!! Eejits are never gonna get their money like that!
