    Cheque fraud (kind of)

    I went to the Ivy restaurant a few months ago on a friday (which was pay-day) and at the end of the meal paid with a cheque.

    For some reason that month, there was a screw up in the wages dept, and we didn't get paid until the following tuesday. A couple of days after that i got my bank statement and noticed that the cheque was received on the tuesday, and not cleared as my wages hadn't cleared by then. So essentially i got a meal at London's most famous restaurant for free. All well and good.

    I've just got a call on my mobile form the Ivy, from an embarassed french guy explaining to me that my cheque did not clear. I can probably afford to pay it, but would rather not with it being so close to xmas/nye and all.

    Is there any way to avoid it?

    you shouldn't have to pay it

    if the company has accepted the cheque with the total cost of the meal beign over the cards cheque guarantee that is there problem

    as far as u r concerned u have met all your requirements as a customer

    u have payed using cheque

    if the card doesn't have a cheque guarantee limit then the restraunt shouldnt have accepted it, and it is there fault
    likewise id the meal was over the limit of the cards cheque guarantee then it is there fault

    if the meal price is under the limit then the bank should have honoured the cheque and you should have gone overdrawn (and no doubt would have been charged)

    The meal was £150. The cheque guarantee limit is £100.

    Does that mean i don't have to pay?

    u shouldnt have to, it is there fault for accepting a cheque that is over the limit of your card

    im pretty sure that is the case anyway

    if you pay for something using a £10 note and the cashier gives u change for a £20, he cant then phone up a week later and say "i gave u too much change can u come back in to sort it out with me"

    im guessing the same applies here

    Guess i must've left it when i made the booking.

    Have just found this. Which makes it sound as if i have to pay, although it mentions several times that the limit for legal action is £750 or above.

    they wont pursue you for that amount, not a "small" business.

    £150 for two people. Drink each at the bar first, 3 courses each, bottle of wine, coffee afterwards. Not too expensive really (esp given that the wine was £30!).

    I had fillet of red deer with Haggis and Neep* mash.

    I don't mind ignoring their calls. Was just worried about what their next course of action would be. Tehy've got my bank details etc. from the cheque.

    just by having someones acc # and sort code dosnt mean u have access to their bank account funds... the only way they could do that is to forge a direct debit request......

    you cant be blacklisted either unless the sue you which isnt going to happen

    They cant take any money out the bank without your permission the cheques been returned unpaid so is useless. Just ignore them.

    Didnt you know that your cheque guarentee card's maximun spenditure was only £100? They will probs think u knew and were trying to get away with a free meal!! :p
